FlipaClip Film Festival Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. 

ELIGIBILITY

To enter The FlipaClip Film Festival (hereafter “Contest”), you must be 13 or older. Visual Blasters, LLC (“Sponsor”) is allowing users to create an animation project for the contest called “FlipaClip Fun Festival”. This contest is void in Cuba, Iran, Iraq, Kuwait, Lebanon, Libya, North Korea, Qatar, Saudi Arabia, Sudan, Syria, United Arab Emirates, Yemen, the Province of Quebec, or any place where prohibited or restricted. Employees, officers or directors of Sponsor, or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this contest (collectively, the “Contest Entities”), as well as the immediate family and household members of each such person are not eligible to participate. This contest is subject to all federal, state and local laws and regulations.

Eligible entrants who are under the legal age of majority in their state of residence (a “minor” ) must get their parent or legal guardian’s permission to enter.  A minor entrant will be required to prove parental consent in the form of an Affidavit of Eligibility before he or she can be declared a winner and any prize can be awarded.

CONTEST PERIOD: 

The Contest begins on July 5, 2024 at 4:00:00 p.m. Eastern Time (“ET”), and ends on September 1, 2024 at 11:59:59 p.m. Eastern Time (“ET”) (the “Contest Period”).  

HOW TO ENTER: 

During the Contest Period, complete the following steps: 

  1. Download the free FlipaClip app (“App”) onto an iOS or Android device.
  2. To participate press the “Start Now” button in the promo pages or press the “Start” red button in the contest screen;
  3. You must use, at minimum, one of the project templates, to participate in the contest. If you need the project template again you can retrieve it from the official contest page in the FlipaClip app. Make sure to follow all Entry Requirements.
  4. To submit an entry do the following:
    1. You must upload your final animation to one of your own social networks.
    2. Next, you must submit the entry/entries by sharing your social media video link in the contest page in the FlipaClip app in order to be considered as taking part in the contest.
      • You must sign in or create a free FlipaClip Contest Account within the app to be able to submit your entry. 

ENTRY REQUIREMENTS: 

All entry submissions must: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image, (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity, (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans other than the Sponsor’s, (e) not depict any conduct or content that is unsafe, immoral, obscene or otherwise inappropriate as determined by Sponsor in its sole and absolute discretion; and (f) not have been submitted in any other contest or won any prize. Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification. Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules. Sponsor may post or not post any Submission on the Website or in any other form of communication in its discretion.

PUBLICITY/USAGE RIGHTS: 

By entering, you warrant and represent that your Submission has been created by you as an original work and that all required third-party releases (if any) have been obtained in writing, and you further agree acknowledge and agree that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast and otherwise use your Submission in whole or in part in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online. Except where prohibited, participation in the contest and/or receipt or use of any prize further constitutes the winner’s consent for use of his/her name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).

WINNER SELECTION: 

All eligible submissions during the Contest Period will be evaluated by a panel of judges using the following criteria: Creativity, Effort, and Quality. Each video will be rated on a scale of one (1) to ten (10) for each of the three (3) categories. The total of that rating will be the basis creating the top contenders. In addition, the number of views, likes, or shares may be considered as a factor by the judges in their decision. Judges’ decisions are final and binding on all matters relating to the contest. 

WINNER NOTIFICATION:

Potential winners will be notified via Email or social network private message at the contact information provided by the winning entrant at time of entry on or before Sep 6, 2024. No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential winner does not respond within three (3) days after the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected. The selected winner must allow access to the original work project backup to be used in creating the final music video. If access cannot be given an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Each winner may be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (where legal).

PRIZES:  

  • Best in Drama – $1,000 USD cash prize
  • Best in Comedy – $1,000 USD cash prize
  • Best in Adventure – $1,000 USD cash prize
  • Best in Free Style – $1,000 USD cash prize

Prizes are non-transferable, and no cash alternative or prize substitution will be allowed, except at Sponsor’s discretion. A substitute of comparable or greater value may be awarded if the prize listed becomes unavailable for any reason. Winner is responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize.

RELEASE OF LIABILITY: 

By entering the contest, each entrant (a) releases the Sponsor from, any and all liabilities, costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the contest or any contest-related activity, or from acceptance, receipt, possession and/or use or misuse of any prize, or any typographical or other error in the printing, offering or announcement of any prize. By entering the contest, you further agree that (b) Sponsor has not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose; (b) any and all disputes, claims, and causes of action arising out of or in connection with the contest, or any prize awarded, shall be resolved individually without resort to any form of class action; (c) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the contest, but in no event attorney’s fees; (d) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses; (e) each entrant shall release Sponsor from any liability which may arise from any use given by Sponsor to any work created by each entrant; and (f) Sponsor will not be held liable, for any intellectual property and/or any trademarks shared by an artist, during the contest, used by Sponsor for marketing purposes and/or any other use determined by Sponsor.  Regardless of where you are when you enter, the contest is deemed to take place in the United States.  These rules and any disputes relating hereto are governed by the internal laws of the State of Florida without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in Florida for resolution of any disputes relating to the contest and waive any objection thereto. 

INDEMNIFICATION: 

You agree to indemnify, defend and hold harmless the Sponsor and its owners, members, employees, affiliates and agents from and against any and all third-party claims alleging that you have violated any of these rules or that your entry infringes any copyright or trademark or violates any right of any third party.

ADDITIONAL RULES: 

No responsibility is assumed for any damage to your mobile device or computer system which is occasioned by participating in the contest, or for any computer system, mobile device, hardware, software or program malfunctions, or other errors, failures or delays. Without limiting the generality of the foregoing, no responsibility is assumed for incomplete, illegible, misdirected, misprinted, forged, tampered with, altered, late, lost, damaged, or stolen submissions, prize notifications or other contest materials, all of which are void; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Any individual who is found to be tampering with the entry process or the operation of the contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the contest, or to annoy, abuse, threaten or harass any other person, may be disqualified, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor reserves the right to modify, extend, suspend, or terminate the contest, in whole or in part, if it determines, in its sole discretion, that the contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the contest as contemplated herein. If the contest is terminated before the designated end date, Sponsor will (if possible) select the winner from all eligible, non-suspect entries unaffected by the problem.  The entry will be deemed submitted by the authorized account holder of the phone number or email account associated with the entry or through which the entry was submitted.  “Authorized account holder” shall be defined as the natural person who is assigned to the FlipaClip account based on our account records.  Selected winners may be required to show proof of being the authorized account holder.

WINNER LIST:  

For the winner’s name, available after Sepember 6, 2024, send a stamped, self-addressed envelope to: Visual Blasters, LLC, Attn: FlipaClip Film Festival, 382 NE 191st St Suite 76222 Miami FL 33179. All such requests must be received by Oct 31, 2024 .
